This website is operated by Phoenix Security Academy, ALL Students of the Phoenix Security Academy are required to abide by and follow the policies set forth herein.
Students of the Phoenix Security Academy have received notice of the following Policies, Rules & Release of Liability.
Phoenix Security Academy reserves the right to change its policies at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately. Please check the latest information posted herein to inform yourself of any changes.
1. IN-PERSON STUDENTS
All in Person Students are given notice of Phoenix Security Academy Policies & Release of Liability. All students must agree to the aforementioned in order to attend any training class with the Phoenix Security Academy.
2. RELEASE OF LIABILITY / ASSUMPTION OF RISK FOR TRAINING ACTIVITIES & POLICIES
As per Phoenix Security Academy policies in order to participate in ANY of the classes offered by Phoenix Security Academy you must agree to the following prior to the beginning of class:
I, in consideration of the use of the training facilities at Phoenix Security Academy, declare and agree as follows:
I. I acknowledge that all training and fitness/training activities carry with them the potential for personal property damage, personal injury, and death.
II. I assume all risks of injury arising out of my participation in any training exercise, including my use of any Phoenix Security Academy equipment.
III. I certify that I am physically fit and able to participate in training exercise and have not been advised otherwise by a qualified medical person. I have received sufficient training for participation in any training activity and equipment use.
IV. I release and agree to indemnify Phoenix Security Academy and its trustees and employees including trainers from any and all liability, loss, damage, expense, or cost of any nature whatsoever for any and all claims that are known or unknown, foreseen or unforeseen, future or contingent, for personal injury or property damage arising out of training exercises at Phoenix Security Academy.
V. I agree that I shall not now or at any time in the future, directly or indirectly, commence or prosecute any action, suit or other proceedings against Phoenix Security Academy and/or its trustees and employees arising out of, relating to, or in connection with my use of any training equipment and/or participation in any training exercise or activity.
VI. I consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during my participation in training exercise at Phoenix Security Academy.
VII. I attest that I am of legal age to sign this form as a binding legal document in accordance with its intention.
VIII. Phoenix Security Academy instructors and staff reserve the right to dismiss a student at any time for any
reason. I understand and agree that I may be summarily dismissed from class if I engage in any unsafe, disruptive or abusive activity. I understand there is zero tolerance for cheating, theft and/or destruction of property.
IX. I understand I shall not receive a full or partial refund for any courses I fail to successfully complete. Nor shall I receive a full or partial refund if I am dismissed from a training course for any reason.
3. PERSONAL INFORMATION/ CONFIDENTIALITY
Phoenix Security Academy will properly handle personal information of Students/Users in accordance with the Phoenix Security Academy’s Privacy Policy. All student information and records will remain confidential. Exceptions will only be made in the event:
- The Student has requested specific information be made available to specified people or entities.
- A Security Company has registered and paid for their employee’s training.
- The TXDPS/Regulatory Services Division or other legal State Authority requests or audits training records.
4. COPYRIGHTS and OTHER RIGHTS
- Copyrights, trademarks, portrait rights and all other rights relating to this website belong to Phoenix Security Academy and The State of Texas unless specified otherwise. Users are asked to respect the protection afforded to holders of copyrights, trademarks, portrait rights and other rights.
- Users are prohibited from using, transposing, copying, distributing or modifying all or part of the data, images and any other form of content obtained from this website for any purpose other than personal use, as specified in copyright laws, or that which is explicitly permitted by other laws, without the consent of Phoenix Security Academy.
- If it is revealed that a student has copied the information contained in this course, either manually or electronically, the student will be subject to dismissal from the class without a refund. Additionally, the student may be subject to civil litigation.
- Taking notes is acceptable, but copying, plagiarism and redistributing the information herein is strictly prohibited. Legal action will be taken against all violators.
5. LAWS/ RULES REGARDING ARMED LICENSURE
- Regardless of whether a student holds a License To Carry (LTC) or he/she exercises their Constitutional Right to carry a firearm, he/she may NOT carry a firearm while engaging in the duties of a paid/contracted security officer. In order to carry a firearm while on duty, he/she MUST be a licensed (Level 3) Commissioned Security Officer. Failure to comply, may result in criminal charges being filed by the State or District Attorneys Office(s).
- The completion of a course does not constitute licensure. Completing the course and obtaining the certificate is a required step in the process of procuring a security license. The license itself is approved and issued by the Texas Department of Public Safety/ Regulatory Services Division.
Commissioned and Non commissioned officers can only begin working for a licensed company at an unarmed post if:
- they have completed the course,
- submitted their application and
- submitted fingerprints (Must wait 48 hours after submission of prints).
- Once the non-commission card has beed received it must be carried while on duty.
Commissioned (armed) officers must wait until they have received their commission card in order to work an armed post, and must carry their commission license while on duty.
6. STUDENT RECORDS
- Phoenix Security Academy maintains student records for two years, as per the TXDPS requirements (Rule 35.147)
- Only one Certificate of Completion will be issued per Course. It is the student’s responsibility to preserve a copy for his/her records.
- A $10.00 fee per certificate/record will be charged for to replace lost or stolen documents. You may send us with an e-mail, requesting a copy of your certificate(s). Please include your full name, the last 4 digits of your SSN and the date or approximate date when you attended the class. Please note, if your certificate is more than a year old then it is no longer valid (see 1702.302 (d) OC).
7. WEBSITE OPERATION
Phoenix Security Academy may change, add, suspend, cancel, remove or otherwise modify the services offered on this website at any time without prior notice.
8. PROHIBITED ACTIONS
Users of this website are prohibited from engaging in the following actions, including those prohibited by other provisions of these terms and conditions:
- Actions that will or may infringe on the copyrights, privacy, property and other rights or interests of other users of this website, third parties or Phoenix Security Academy.
- Actions that will or may cause disadvantage, financial loss or other damages to other users of this website, third parties, or Phoenix Security Academy.
- Actions that will or may be offensive to public order and morals, or violate laws, regulations, and ordinances.
- False declarations when using this website for membership registration or other purposes.
- Illegitimate use of email addresses, passwords, or other personal information.
- Using this website to solicit business or achieve other commercial ends for profit, or for preparations thereto.
- Other actions that may interrupt the operation of this website or interfere with the provision of services.
9. ONLINE STUDENT/ MEMBER/ USER
- Phoenix Security Academy reserves the right to immediately cancel a student membership, at any time without prior notice, if any of the following conditions apply to a student:
- The student intentionally gave false or inaccurate information to Phoenix Security Academy when registering for a course.
- The student intentionally enrolls in a course knowing he/she is disqualified from receiving a license due to his/her criminal record.
- It becomes clear that the student has had his/her membership revoked or received some other form of censure for violating these terms and conditions of use or other regulations in the past.
- The student engages in activities prohibited by the terms and conditions of use, or other Phoenix Security Academy policies.
- The student cannot be contacted via email, telephone or other means.
- Phoenix Security Academy deems any other act of a student as inappropriate.
- The student shall notify Phoenix Security Academy of any changes in his or her registered name, address, phone number or other personal information using means specified by Phoenix Security Academy.
- The student shall use his or her account information and password only for personal use, and must not transfer, loan, or otherwise provide them to third parties for the use of such third parties. ONLY the student who signed up for the class is permitted to complete the class.
- If it is discovered that a student did not complete the course on their own he/she will not receive a certificate of Completion or a refund and the State of Texas Regulatory Services will be informed so they may take action regarding the fraud committed.
- Students with a Criminal Record must inform our staff so that we can confirm they meet the State’s requirements to obtain a security license in Texas. If he/she is disqualified due to their criminal background and they choose to continue with the class without informing our staff then he/she will NOT receive a refund for the class. (See section regarding Disqualifying Offenses for more information).
10. ONLINE CLASS POLICIES/ EXPECTATIONS
- ONLY the student who signed up for the class is permitted to take the class, and complete the lessons, quizzes and Final Test therein.
- If it is proven that a third party completed the class in place of a student then the student will not receive a certificate of Completion nor will he/she receive a refund. Additionally, Phoenix Security Academy will inform the Texas Regulatory Services so they may take action regarding the fraud committed. If action is taken the student licenses are subject to revocation.
- Students will be given a reasonable time frame to complete each course. The designated time frame may differ from course to course. Refunds will not be given to those who fail to complete the course within the allotted time.
- If additional time is needed due to extenuating circumstances, the student MUST contact Phoenix Security Academy 24 hours before the date the student’s course is due to expire. At the discretion of Phoenix Security Academy, we may offer a course extension, on a case by case basis.
- The student should carefully read all information in each Lesson and pay attention to videos (if applicable). Once the student has successfully completed a course and has passed the Final Test, he/she will be able to download their Certificate from their “My Account” profile.
11. DISQUALIFICATIONS
All security licenses require you to have a fairly clean criminal record.
Having a criminal record may disqualify you from receiving a security license for a period of time. Not all offenses are disqualifying. If you want to know more about the specific list of criminal offenses that are disqualifying then look up the Texas Administrative Code Rule §35.4 Guidelines For Disqualifying Criminal Offenses.
You can usually determine your eligibility by the classification of the conviction:
- Class C misdemeanors are not disqualifying.
- Class B misdemeanor’s typically disqualify for two years from the date of conviction.
- Class A misdemeanors disqualify for 5 years from date of conviction.
- Felonies disqualify for 10 years from conviction date.
NOT ALL convictions are disqualifying. For instance, a first offense, minor Marijuana Possession (less than 2oz) as a Class B misdemeanor would not disqualify. A second offenses Class B would disqualify for 2 years.
Currently, a first offense DWI, Class A misdemeanor would not disqualify. Yet a second offense DWI would then disqualify for 5 years.
Every few years the state reviews these policies and rules so they do change slightly from time to time.
The state will not issue a license to those who are on probation. If you are currently on probation you must successfully complete your probation and meet the above requirements in order to obtain a license.
You cannot have any open warrants for any reason (even something small like an unpaid parking ticket). All warrants must be resolved before the state will issue a license.
If you were recently arrested and/or have criminal charges pending you cannot obtain a license until the charges/case has been resolved.
For those who have served in the military dishonorable or other-than honorable discharges may disqualify you from obtaining a security license.
There are offenses that are PERMANENTLY DISQUALIFYING: Independently of whether the offense is otherwise described or listed above, a conviction for an offense listed in Texas Code of Criminal Procedure, Article 42.12 §3g, or Article 42A.054, or that is a sexually violent offense as defined by Texas Code of Criminal Procedure, Article 62.001, or a conviction for burglary of a habitation, is permanently disqualifying subject to the requirements of Texas Occupations Code, Chapter 53.
Possible Disqualifications Not Related to Criminal Background
- If you owe back taxes
- If you owe back Child Support
You must contact the regulating agency and set up a payment plan in order to be in good standing before the State will issue you a license.
- If you have ever been under psychiatric care or been institutionalized in a mental hospital please inform our staff as, this may or may not disqualify you from being a commissioned (armed) security officer.

If you know you are not eligible DO NOT TAKE A CLASS, because the State WILL NOT issue a license and we WILL NOT issue a refund for classes completed (intentionally and knowingly) by non-eligible students.
Please Note: Disqualifying Offenses are subject to change as per State Regulations.
11. MMPI REQUIREMENTS/ POLICIES
All Commissioned and PPO licenses require licensees to get a Psychological Evaluation (MMPI) with a licensed psychologist. This may be completed before or after completing the required training security training classes.
No refunds will be issued to students who fail to pass the MMPI.
12. REFUND POLICY
Phoenix Security Academy does not issue full or partial refunds for training.
Students shall not receive a full or partial refund for any course which they fail to successfully complete. Nor shall they receive a full or partial refund if they are dismissed from a training course for any reason.
